Terms and Conditions Regarding (1) Capture and Use of Images and Likenesses and (2) Release of Liability
By entering these premises, you authorize VNGR Beverage LLC d/b/a “poppi”, its subsidiaries, affiliates, partners, designees, officers, directors, agents, and employees (together, “poppi”) to photograph and record/video or otherwise preserve your name, image, likeness, voice, biographical material, and oral and written statements (together, “Your Likeness”) and to use and publish written works, video or audio recordings, images, and/or photographs, all in printed, digital, electronic, or other formats now known or hereafter developed, containing any part of Your Likeness (together, “the Materials”) throughout the world in all and any media, including without limitation on printed, electronic, and digital materials, on websites, and on social media platforms, all whether currently known or hereafter developed, for, in support of, and in relation to research, advertising, marketing, promotional, publicity, trade, or any other lawful purpose whatsoever (the “Specified Purposes”).
You acknowledge that poppi will be the sole owner of all rights in and to the Materials, including all rights of copyright, for all purposes, regardless of the form or medium in which they are produced or used. Poppi shall have the right, among other things, to edit the Materials at its discretion, to incorporate any part of Your Likeness in the Materials, to use, duplicate, exhibit, broadcast, and distribute the Materials and to license others to do so in all media now known or hereafter devised. You waive any right that you may have to inspect or approve any part of the Materials that incorporate Your Likeness. You release and discharge poppi from any and all liability arising out of or relating to its use of Your Likeness, including without limitation claims based on the rights of privacy or publicity; on any blurring, distortion, alteration, optical illusion, or use in composite form, whether intentional or otherwise, that may occur or be produced in the use of Your Likeness; or on any editing or alterations to the Materials.
In consideration for the rights you have granted to poppi, you shall receive the opportunity to have Your Likeness appear in the Materials. You acknowledge, however, that poppi shall be under no obligation to use any part of Your Likeness. You further acknowledge that you will not receive any monetary compensation for any use of Your Likeness and you shall not be entitled to receive any proceeds that may be derived from the Materials. You consent to poppi storing the Materials and copies of YourLikeness for the Specified Purposes. You also consent to poppi transferring the Materials and copies of Your Likeness to any destination throughout the world or storing them at a destination anywhere in the world for the Specified Purposes.
BY ENTERING THE PREMISES, YOU ALSO ACKNOWLEDGE THAT YOU ARE ENGAGING IN ALL ACTIVITIES AT YOUR OWN RISK, AND YOU RELEASE POPPI AND ITS EMPLOYEES, SHAREHOLDERS, CONTRACTORS AND SERVICE PROVIDERS FROM ALL CLAIMS AND LIABILITIES ARISING FROM OR RELATED TO YOUR PRESENCE ON THE PREMISES AND/OR YOUR PARTCIPATION IN ACTIVITIES ON THE PREMISES.
